Advocate Julie Seton, a leading figure in the representation for the DA and other public figures in legal actions against me, is committing misconduct.
As background, I am a community activist and citizen journalist. Seton initiated several cases against me, under instruction from Carl Jeppe Attorneys, on behalf of four public figures who include Deputy Mayor Esme Edge, Councillor Richard Dawson, CEO of Knysna Tourism Greg Vogt and the Deputy Chairperson of the CPF for the Western Cape Magda Moos. All are related to my attempts to bring to justice to those responsible for the maladministration of Knysna Tourism and it’s debt being illegally funded with taxpayer’s money.
I consider the legal attacks as an abuse of the law as they’re doing so on individual basis when they are clearly not. Worse is the abuse of the Harassment Act for political ends. In fact, the Knysna Magistrate’s Court wouldn’t accept two of the cases so they have gone to High Court where I hope similarly will be realised too.
Just imagine the consequences of these actions… they’d be precedent for us not being able to criticise politicians such as President Jacob Zuma. So maybe that isn’t their endgame. Maybe there isn’t an endgame. Maybe it’s just to ensure that I’m kept busy until Seton’s clients are elected or re-elected.
Twice, I have been illegally served papers NOT at my address. I consider this intimidation. The first time was in the Knysna Magistrate’s Court, on behalf of Magda Moos, a client of Seton. I do not consider it a coincidence that I was there regards another charge involving Seton and the same client. The second time was after a Knysna Council meeting – Seton and two sheriffs were waiting for me at the door, serving me on behalf of Deputy Mayor Edge.
Furthermore, regards Moos, in front of Magistrate Goosen and myself, Seton lied that she did not require an instructing attorney as she was acting pro bono.
Whilst engaged in these legal actions, Seton has been supporting a propaganda campaign against me on a Facebook page entitled Knysna Knews. The page’s purpose is suspicious because when bad news is mentioned it is only about me. The page is also anonymously authored although likely involvement includes Mark Allan, the most active person there. I have a Protection Order against this man (who used 10 fake identities) but getting the police to enforce it is problematic (i believe that’s as a result of me being a critic of the local police too).
What is exceedingly ‘odd’ is that Advocate Julie Seton and one of her clients, Deputy Mayor Esme Edge (one of the applicants against me), are, along with Mark Allan the quickest to spread anonymously authored posts aimed at discrediting me. The timing of such is too close to be accidental i.e. I believe that they are working together. Considering the language of the posts (sometimes legalese) and the (misinterpretation of) knowledge involved, it’s possible that Seton and Edge are also co-authors.
It is highly improbable that an Advocate and a Deputy Mayor would be glued to one anonymously run Facebook page let alone whilst they occupy high powered, supposedly demanding jobs. The General Council of the Bar (GCB) states in its Uniform Rules of Professional Conduct:
- 4.18.3(e) It is contrary to professional etiquette for counsel to engage in newspaper correspondence or to issue press statements on the subject of cases in which they are or have been themselves concerned as counsel.”
- 4.21.1 A member must not issue any statements to any news or current affairs media in connection with any matter in which he/she is or has been briefed or instructed.
Sharing and Commenting against me is a breach of etiquette and should be termed misconduct. Worse is that Advocate Julie Seton is spreading disinformation/propaganda to the public whilst working for public figures. She is supporting blatant lies about me (whilst she is in court with me).
I have reported Advocate Julie Seton to the Cape Bar.
