Today, I won my rescission case against Mark Allan who was represented by Advocate Julie Seton. Carl Jeppe, their instructing attorney, was (again) absent.
My poor understanding of the law is dangerous as I can only afford to represent myself. Consequently, I mistook an intention to defend as a plea. That resulted in a default judgement against me (which I was unaware of) for a sum of R35 000. As I can’t afford that, it got reinterpreted into my computer, my cellphone, CDs and books ironically being awarded to Mark Allan, the man and his 10 fake identities which i proved cyberstalked me, accusing me of the most horrendous things.
As Advocate Julie Seton is active with him on the same web pages against me, I asked for her to be dismissed as his counsel – I consider both of them, along with others, to be part of the political campaign to discredit me (after all, the main beneficiaries of such bad publicity seem to be Democratic Alliance politicians and Knysna Municipality staff I’ve accused of maladministration and corruption).
Unfortunately, Magistrate Thafeni, new to the Knysna bench, wouldn’t do so, making me think that I was going to be faced with a loss reminiscent of the attitude of old magistrates I’ve had to stand before. I was wrong.
Suspiciously (to me), them gaining my computer and cellphone would have effectively hampered my fight against wrongdoings in Knysna as well as my free promotion of good things. It would also have given them access to sensitive information as well as hampered my ability to prepare my defence in other cases.
It would have been made even more ironic by the fact that I have a Protection Order against Mark Allan.
Instead, I won the rescission of judgement, meaning that the default judgement has been killed and I’ve earned the constitutional right to a fair trial…
…but now I know a bit more about the law so I will be sure to counter sue. I finally get my chance to present my evidence.
Somebody asked me why I don’t look happy. I told them that I’m not unhappy, it’s just that this is one step in a road of many. But to not seem unappreciative (because I am), let me end on a smile…
Marilyn Manson’s ‘Sweet Dreams are Made of This’ or ACDC’s ‘Highway to Hell’ would be more my type of soundtrack for this moment but the bar’s current ‘Dancing Queen’ by ABBA will have to do 🙂
