Marijuana Semi-Legalised in the Western Cape
MARIJUANA ‘LEGALISED’: The Western Cape High Court has ruled that home use of dagga, and the cultivation thereof, is a Constitutional right and must be legalised. Parliament has been given 24 months to alter relevant legislation.
The case was brought by Gareth Prince (Rastafari) and Jeremy Acton (Dagga Party) against the Minister of Justice and Constitutional Development, the Minister of Police, the Minister of Health, the Minister of Trade and Industry and the Director of Public Prosecutions.
In the meanwhile, Judge Dennis Davis has ordered that all prosecutions be paused. Please note that this only applies to personal home use. Growing too many bushes in your garden may still get you into trouble. Wait for further details.

PS: I look forward to seeing future SAPS drug statistics. I’m against abuse of any substance but it’s important that we separate dagga from heavier drugs like tik, thus freeing up police and court resources.
