Marijuana Semi-Legalised in the Western Cape

Mike Hampton Posted on 31st Mar 2017 by mikehampton1st Nov 2020

MARIJUANA ‘LEGALISED’: The Western Cape High Court has ruled that home use of dagga, and the cultivation thereof, is a Constitutional right and must be legalised. Parliament has been given 24 months to alter relevant legislation. The case was brought by Gareth Prince (Rastafari) and  Jeremy Acton (Dagga Party) against the Minister of Justice and Constitutional Development, the Minister of Police, the Minister of Health, the Minister of Trade and Industry and the Director of Public Prosecutions. In the meanwhile, Judge Dennis Davis has ordered that all prosecutions be paused. … Read the full article…

Marijuana on Trial in South Africa Next Year

Mike Hampton Posted on 18th May 2016 by Mike Hampton1st Nov 2020

The Trial of the Cannabis Plant is due to start in the Pretoria High Court, Gauteng province, South Africa on 31 July 2017 until 25 August 2017. This is a total of 19 high court days. Our legal team at Schindlers Attorneys consulted with Deputy Judge President Ledwaba recently and it was established that these were the first available dates on the court roll for a special (long term, public interest) trial. Accordingly, various dates were set as deadlines over the next year for both parties to get their evidence … Read the full article…

Helicopters, Marijuana & Survival

Mike Hampton Posted on 9th Apr 2016 by Mike Hampton1st Nov 2020

The villagers keep watch from January, waiting for police helicopters to thud over the hills. Every year, for nearly three decades, their plantations have been poisoned towards the end of summer, right before harvest, leaving behind fields of withered stalks. “We hear rumours that they are coming, that they’ve started spraying nearby,” said one resident, a middle-aged woman with smooth skin and arched cheeks, when GroundUp visited in March 2016. “Then we know the helicopters will be arriving soon – but there is nothing we can do.” The village of … Read the full article…

Dagga, Assisted Suicide, Knysna and Hero Robin Stransham-Ford

Mike Hampton Posted on 7th May 2015 by mikehampton1st Nov 2020

The high profile advocate died after a long battle with cancer, two hours before Pretoria High Court Judge Hans Fabricius ruled in favour of his application for assisted suicide. O’Regan J: “The right to life is more than existence, it is a right to be treated as a human being with dignity. Without dignity human life is substantially diminished. Without life, there cannot be dignity.” As the advocate for www.fieldsofgreenforall.org.za, Stransham-Ford was assisting Knysna residents with applications for stays of prosecution until the law making cannabis illegal is challenged at … Read the full article…

Will Dagga Convictions Stop in Knysna on March 13 2015?

Mike Hampton Posted on 6th Feb 2015 by mikehampton1st Nov 2020

Dagga’s been a vigorous debate on my sites before and on February 13 a court case in Knysna could change much about it locally. Dagga isn’t an easy topic and it’s rare to find moderate opinion on both sides. I don’t want school kids smoking because a side affect, especially for newcomers, is demotivation – obviously legalisation will increase usage. I also don’t like falsehoods such as “it cures asthma” (as an asthmatic, i know it makes it worse – tar content is up the yin-yang). And i never want … Read the full article…
